You are guaranteed that we will send the number of visitors that you have purchased to the URL that you specify, for as long as your traffic campaign URL remains in compliance with these Terms. This is the only guarantee for our services.
All traffic services are covered by our 30 (Thirty) day guarantee. Delivery of traffic will continue past the thirtieth day until you have received all the visitors that you purchased, if no claim is made. All clients have the right to claim a refund, for any reason, as long as it does not pass thirty days after the order. If a client is issued a refund, his campaign is imediatly canceled and he will be unable to order further packages from TrafficMother.com
All Traffic packages are “open ended” deliveries. We guarantee to deliver all the visitors that you purchased, but we cannot guarantee to deliver them within sixty days. Expedited campaigns can be set-up for an extra fee.
If we are unable to deliver the number of visitors promised, you may claim a refund. In cases where refunds are claimed based on this, we reserve the right to require proof that the proper number of visitors were not delivered.
Stats, data, and other information from third party counters are not sufficient to establish a claim. These counting systems tend to yield an improper count. If we dispute your claim, you must provide us with raw server logs from the site and time period in question – this is the only reliable method of counting a visitor.
For all traffic services the following conditions apply:
We will not deliver visitors to sites with popup windows of any kind, i.e. Pop Ups, Pop Unders, Pop Behinds, Exit Pops, etc. Any additional window generated by your site shall be considered a popup window, including dialog boxes, and javascript alert windows.
We will not deliver visitors to sites containing content that is not appropriate. Inappropriate content includes, but is not limited to: child pornography, hate text, illegal content and content that encourages illegal activities or violence. What constitutes inappropriate content shall be determined at the sole discretion of our administrative staff.
All traffic campaigns must be sent to a single website URL. (”Split” campaigns to several URLs can be set-up for special cases, after adicional fees are applied) Frame-breaking code, background music or sound, automatic downloads or scripts that alter user browser settings (auto homepage, bookmarks, etc.), advertising servers, ad rotators, or redirects of any kind are NOT allowed.
After a campaign is processed and visitor delivery started, it’s not allowed to change the destination URL of the campaign. If the client wishes to send visitors to another URL a new order needs to be placed
In the case of targeted orders, a URL change by the client initiative changes their campaign status to “pending”. In this case, the new URL is only accepted in the next business day and only if it complies with these terms.
After Targeted Orders are processed, the status is setup to “pending” until the following business day.
We will review your site before beginning the campaign. If your site is changed during the campaign, such that it includes inappropriate content, or violates the Terms and Conditions above, we may stop your campaign immediately, and you will not be entitled to a refund.
All orders are manually reviewed, and if your website complies to our terms of service, all orders are processed within 3 business days. If the deadline of 3 business days is crossed without your order being processed, you are entitled to a full refund of your payment. within 3 business days after the order was placed and paid, all clients are e-mailed with a login and password to access stats on the progression of their campaign.
We only rely on our tracking system for the number of hits sent to your website. Our tracking is the most accurate because the “hit counts” are incremented at the same exact time a visitor is sent to your site. Unlike third party counters, we do not have any load time to worry about. There are an enormous amount of counters with various load rates and it is impossible to accomodate each customer’s counter. For example, some counters take as much as 30 seconds to count a visitor – some even more. We cannot control the behavior of the end user, or force them to stay on the site a certain length of time. If they choose to ‘close out’ prior to your counter load, it is still considered a delivered visitor. This is how we are charged by the networks that supply us traffic, which leaves us no other option but to charge our customers in the same manner.
The definition of TrafficMother for the term “visitor”, is when a visitor loads your webpage, being what many third party counters refer to as “Pageloads”. In the case of “Global Traffic” Orders, all clients must be aware of the fact that visitors ARE NOT Ip Unique, which means that the same person may load the same page SEVERAL TIMES and each of those times will be counted as a “VISITOR” for TrafficMother and as a “Page Load” for many third party counters. Targeted Traffic Packages may or may not be IP unique.
The source of visitors of “Global Traffic” Packages can include any number or combination of the following at any give time: pop-unders, pop-ups, redirected domains, traffic exchanges. These refered sources can also change at any given time. Due to the multiple sources of this type of traffic, be aware that the visitors from “Global Traffic” packages are almost NEVER delivered in the form of full page. TrafficMother is aware that this type of traffic is not the most adequate to convert into sales or signups, being more usefull to increase your rankings in traffic.
In no event shall we be liable for any consequential, direct, indirect, incidental, punitive, or other damages whatsoever (including, but not limited to: damages for loss of profits, loss of information or other pecuniary loss) arising out of the use or inability to use our services, even if we have been advised of the possibility of such damages.
We cannot be held responsible for factors beyond our control that may interfere with our ability to deliver visitors to your URL. Such factors include, but are not limited to: downtime on your server, overuse of your bandwidth quota (if applicable), errors on your site, and network outages beyond our servers. Please contact your web hosting company or network provider if you are unsure about whether your hosting account is sufficient for the program you are ordering.
Clients shall not make an order if they do not CLEARLY Understand any of the points explained in these Terms of Service. It’s the client sole responsability to Read our Terms of Service. When ordering, the client ACCEPTS OUR TERMS OF SERVICE, because it’s CLEARLY WRITTEN “By Ordering you Agree to our Terms of Service”, providing a quick access to the same by the means of a link.
Any clients claim that they did not know about our Terms of Service, it’s NOT Considered Valid.
TERMINOLOGY: (1) In the present context, a “visit” generally occurs when a text file is loaded from your server (this includes HTML files). A “hit” occurs when a file is loaded from your web server. Since loading a single web page can cause several files to load (e.g. images), several hits usually occur when a page is loaded. Thus, the number of hits is always greater than (or equal to) the number of visits. The term “number of visitors” is interchangeable with the term “number of visits.” Several “visits” may originate from a single IP address or individual. This generally occurs when an individual returns to or reloads a webpage.
If any provision of this Agreement is deemed invalid or unenforceable by any jurisdiction or government agency having jurisdiction, that particular provision will be deemed modified to the extent necessary to make the provision valid and enforceable, and the remaining provisions will remain in full force and effect.
